These Terms and Conditions govern your use of stampcircuit.com and the services Stamp Circuit provides ("Stamp Circuit", "we", "us"). By creating an account, placing a bid or otherwise using the site, you agree to them. If you do not agree, please do not use the site.
1. What Stamp Circuit is
Stamp Circuit is a philatelic auction marketplace. The sales listed on the site are organised and run by independent auction houses (the "auctioneers"). Stamp Circuit publishes their catalogues, transmits your bids to them and provides your account, favorites and bidding history.
Stamp Circuit is not the seller, the auctioneer or a party to any sale. The contract for a lot you win is between you and the auction house running that sale.
2. Each sale has its own terms of sale
Every sale on Stamp Circuit is governed by the terms of sale of the auction house running it. Those terms set the buyer's premium, taxes, payment methods and deadlines, shipping and insurance, bid increments, the handling of returns and claims, and how lot descriptions are to be read. They differ from one auction house to another and may differ from one sale to the next.
You must read the terms of sale of each sale before you bid in it. When you place your first bid in a sale, that sale's terms of sale are presented to you and you must accept them before the bid is placed. Your acceptance covers all your further bids in that sale. The terms of sale are also available on the auction house's own website.
Where these Terms and Conditions and an auction house's terms of sale address the same point, the terms of sale govern the sale and these Terms and Conditions govern your use of the site.
3. Your account
- You must be at least 18 years old and able to enter into binding contracts.
- You must give accurate, complete and current information, and keep it up to date.
- One account per person. Accounts are personal and may not be transferred.
- You are responsible for everything done through your account. Keep your password secret and tell us at once if you believe someone else has used it.
- We may suspend or close an account that breaks these terms, that is used for fraud or shill bidding, or whose holder an auction house reports for non-payment.
4. Bidding
A bid is a binding offer to buy the lot at that price under the terms of sale of the sale. A bid cannot be withdrawn once placed, except where the auction house allows it. The auction house decides which bid wins, may refuse or cancel bids, and may withdraw or re-offer lots.
Invoicing, payment, shipping, delivery, returns and any claim about a lot are handled by the auction house and governed by its terms of sale. Stamp Circuit is not responsible for them, but we will help put you in contact with the auction house if you need it.
5. Our service
Lot descriptions, estimates, images, dates and results are supplied by the auction houses. We publish them as received and do not verify them. Online bidding depends on your connection and equipment and on networks we do not control. We do not guarantee that the site is available without interruption or that every bid is received, and we are not liable for bids that are late, lost or not placed because of a technical failure.
6. Acceptable use
You agree not to:
- place bids you do not intend to honour, or bid to manipulate prices;
- copy, scrape or harvest catalogue data, images or user information, or access the site by automated means without our written permission;
- interfere with the operation or security of the site, or try to access another person's account;
- use the site for anything unlawful.
7. Content and intellectual property
Catalogue texts and images belong to the auction houses or their rights holders. The site's design, software and trademarks belong to Stamp Circuit or its licensors. You may view and print content for your personal, non-commercial use only.
8. Liability
To the extent permitted by law, Stamp Circuit is not liable for any indirect or consequential loss, loss of profit or loss of opportunity arising from the use of the site or from a sale run by an auction house. Nothing in these terms limits rights that the law grants you as a consumer and that cannot be excluded.
9. Privacy
How we handle your personal information is described in our Data Privacy Terms.
10. Changes to these terms
We may update these Terms and Conditions. The date at the top shows the current version. Continuing to use the site after a change means you accept the updated terms.
11. Governing law
Stamp Circuit is operated from Israel. These Terms and Conditions are governed by the laws of the State of Israel, and the courts of Israel have jurisdiction over any dispute about them. This does not affect mandatory consumer protection rights of the country you live in.
